from the Somerset Archives in Taunton, Somerset, UK, a trascription of the office copy of the will of John Burt, dated Aug 26, 1795:
“Extracted from the Registry of the Consistorial Archdiaconial Court of Apells.
In the name of God amen. I John Burt Senr. Stone Mason in the Parish of Montacute in the County of Somerset do make this my last Will and Testament in form and manner following. First I give to my Son John and his Heirs the House and Orchard with all thereunto belonging which my said Son John now liveth in and the said premises to become his property at the day of my death. But if my said Son John Burt should die leaving no Child then the said Premises to become my son Naboths or his heir that shall survive. And I give to my Son John my largest Brass kettle and my second largest Bell metal pot. And I give to my Son Naboth the Dwellinghouse and Orchard that I now liveth in with all Outhouses etc. thereunto belonging and all my household Goods and Furniture except as herein excepted. And I give to my Son Naboth Twenty pounds of lawful money. And all to become his property at the day of my death. But if my said Son Naboth should die leaving no issue then the said Premises to become my said Johns and to be equally divided between his Children that shall then survive and all the rest and remainder of my Effects consisting of Shop Goods, Quarrys and Stone work’d or unwork’d and working Tools and all my Cider Casks and Tubbs of every kind with Bond, Debts, Mortgages, Notes of Hand and Book Debts to be carefully examined by my two Executors hereafter named and after all my Debts be paid then the remainder of all as here aforesaid with all my wearing apparel to be divided equally between my two Sons or their Heirs as herein mentioned to be divided by themselves or any two Friends that they shall chuse to appoint and I do constitute and appoint John Burt and Naboth Burt my two Sons aforesaid Executors of this my last will and Testament. In Witness whereof I have here unto set my hand and Seal this 26th day of August in the year of our Lord 1795
