Notes for William Givan Jr.
from Nina Givan’s memoirs: “Dr. William Givan, M.D., is supposed to have come to Canada in 1828, settled and practiced at Wolfville, N.S., died suddenly of pneumonia. His name is shown on the gate of the family burial lot in the Covenanter churchyard at Grafton (near Berwick). The names of other members of the family buried there are shown on separate stones.”55

In fact William, Jr. bought land in Horton Township on Nov. 22, 1825.56 He is the third Givan on record to buy land in Kings County (after his brother John and his father William). Although he died in 1828 it wasn’t so suddenly as suggested above since he is described as “very sick” at the signing of his will on July 31, 1828 but died 4 1/2 months later.

The gate bears the date 1883 and Ham thinks the name William Givan refers to William R Givan who he thought must have given the gate to the cemetery.12 However, Nina thought the name on the gate referred to Dr. William Givan.
His estate was worth more than 900 pounds, a lot of money in those days. He left the land in Cornwallis that he had inherited to his brother John while all his other lands and possessions were to go to his mother Olivia. When she were to die the estate was to be divided between his two sisters Mary and Ann except for 150 pounds to go to his namesake, a William Givan who was residing with Mr. John McDonald in Milltown, near Omagh, Ireland.
Stone reads William Givin [sic] M.D. died Dec 3 1829 aged 38 years (which would make his year of birth 1791).58 We know from his probate records and obits that he died in 1828.

“No. 3370. This Indenture made the Twenty second day of November in the Year of our Lord One Thousand Eight Hundred and Twenty-five Between Nancy Leonard Widow and Relict of the late Samuel Leonard of Horton in Kings County and Province of Nova Scotia James Allison of Cornwallis in the County and Province aforesaid Esquire and James Noble Shannon of Halifax in the Province aforesaid Merchant Executrix and Executors of the last Will and Testament of the said late Samuel Leonard of the one part and William Givan of Horton aforesaid Surgeon of the other part. Whereas the said Samuel Leonard by and in his said Will and Testament bearing date the Twentieth day of April in the Year of our Lord One Thousand Eight Hundred and Twenty-one and regularly proved and entered on the Probate Records for the County aforesaid on the Twenty-third day of August last past did authorize his said Executrix and Executors to sell and convey certain Lots or parcels of land giving them ample authority for that purpose as by reference to the said Will and Testament will fully and at large appear. Now this Indenture witnesseth that the said Nancy Leonard James Allison and James Noble Shannon in their capacity as aforesaid for and in consideration of the sum of Five Hundred and Sixty Pounds of lawful Money of the Province aforesaid to them in hand well and truly paid by the said William Givan at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened released and confirmed and by these presents do grant bargain sell alien release and confirm unto the said William Givan and to his Heirs and Assigns all that Farm or Tract of land situate in Horton aforesaid and lately in the occupation of the said Samuel Leonard consisting of upland Dike land and Marshland being bounded as follows vis. on the East by lands owned by Joseph Johnson and Hugh Pudsey on the South by a public Road which divides it from James Neary’s Farm on the West by lands owned by the Heirs of the late Gardner Dodge and Euveh Forsyth and on the North by the Cornwallis River containing in the whole about Ninety-three acres be the same more or less together with all and singular the ways waters water courses privileges profits and appurtenances thereto belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and also all and singular the Estate right title interest claim property and demand whatever at law or in Equity of the said late Samuel Leonard and his Heirs in to or out of the same to have and to hold all and singular the said Tract or Lot and land and premises in and by these presents released and confirmed or intended so to be with the appurtenances unto the said William Givan his Heirs and Assigns to the sole and only proper use and behoof of the said William Givan his Heirs and Assigns forever. and the said Nancy Leonard James Allison and James Noble Shannon in their capacity aforesaid do covenant grant promise and agree to and with the said William Givan his Heirs and Assigns that the said Samuel Leonard at the time of his death was lawfully and rightfully seized in his own right of a good sure perfect and indefeasible Estate of Inheritance in Fee simple of and in all and singular the said Farm or Tract of land and premises aforesaid without any manner of condition limitation of use or uses mortgage encumbrance ar any other cause to alter change charge or determine the same. and also shall and will the said Farm or Tract of land and premises aforesaid with the appurtenances unto the said William Givan his Heirs and Assigns warrant and forever defend by these presents. In Witness whereof the parties to these presents have set their Hands and Seals the day and year first herein written.

Obituaries notes for William Givan Jr.
from The New Brunswick Courier, Saturday, Dec. 27, 1828:
“At Horton, (N.S.) on the 11th inst. aged 35 years, William Givan, Esq. a Physician lately from Ireland --greatly respected for his many virtues and his mild and amiable manners, by all who had the pleasure of his acquaintance.”77

In the name of God, Amen. I William Givan of Horton, Nova Scotia, being very sick and weak in body, but of perfect mind and memory, thanks be given unto God, calling unto mind the mortality of my body, and knowing that it is appointed unto all men once to die, do make and ordain this, my last Will and Testament: that is today, principally and first of all, I give and recommend my Soul, into the hands of Almighty God that gave it, and my body I recommend to the Earth, to be buried in decent Christian burial, at the discretion of my Executrix, nothing doubting but at the general Resurrection, I shall receive the same again by the Mighty power of God. And as touching such wordly [sic] Estate wherewith it hath pleased God to bless me in this life; I give, devise and dispose of in the following manner and form.
I give to my dearly beloved mother Olivia Givan, whom I likewise constitute, make and ordain, the sole Executrix, of this my last will and testament, all and singular my lands, mortgages [?], and tenements, together with all my stock, crop, farming utensils, and furniture, by her freely to be possessed and enjoyed, during her natural life, and after her decease to be equally divided between my two beloved Sisters, Mary Givan, and Anne Givan, and also all debts due me, that can be collected, to be equally divided between the Aforesaid Olivia Givan, Mary Givan, and Anne Givan, after

paying all my lawful debts; excepting the sum of one hundred and fifty pounds to be paid to my namesake William Givan now residing with Mr. John McDonald, Milltown, near Omagh, Ireland in case he survives the said Olivia Givan.
I also give and bequeath to my dear brother John Givan, all my right, title, and claim to the property owned by My Father the late William Givan Deceased, as also the aforesaid Olivia Givan, Mary Givan, and Anne Givan do make over their claims to Said property to him the aforesaid John Givan he paying all arrears and charges against the Said farm according to his former agreement, and empower him to collect seventy five pounds that is due on the farm at Cornwallis, toward past payment of the abovementioned property.
N.B. it is to be remembered not including the South Side of the Road, and the new Dyke formerly belonging to Said property,- And I do hereby utterly disallow, revoke and disannul all and every other former Testaments, Wills, Legacies, and Executors, by me in any ways before named willed and bequeathed, ratifying, and confirming this and no other, to be my last will and testament, in witness whereof I have hereunto set my hand and seal this 31st [“31st” is written in another hand by William presumably] day of July [“July” is also written in the other hand] one thousand eight hundred and twenty eight.
